Qualifications

  • Institutional investors defined by the Enforcement Decree and the Enforcement Regulations of the Corporate Tax Act
  • Foreign corporations that obtained investment registration certificates for foreign investors from the Governor of the Financial Supervisory Service (foreign corporations may designate Korean institutions to participate in SBL transaction on their behalf as agents)
  • Other entities the KSFC deems appropriate

    Professional investors defined by the Capital Markets Act; corporations established pursuant to relevant laws

Participants in an SBL Transaction

  • Lender : Lends securities and receives SBL fees (pension/public funds, banks, insurers, collective investment companies, etc.)
  • Borrower : Borrows securities for various purposes and pays SBL fees (domestic and foreign financial investment companies)
  • KSFC (intermediary): intermediates and arranges SBL transactions, manages collateral, handles rights, executes on behalf, etc.

Required Materials

  • Domestic corporation: One copy each for the FATCA self-certification form, customer identification form, corporate registration certificate, registered corporate seal certificate and business registration certificate
  • Non-resident foreign corporation: (with a Korean agent) One copy each of customer identification form, corporate registration certificate, registered corporate seal certificate and business registration certificate (without an agent) One copy each of the FATCA self-certification form, application form for income tax convention, investment registration certificate and power of attorney(POA)
